Those who apply for legal advice Beratungshilfe within the frame of the
counselling law have to pay a contribution of €10 when the service is
being given. The costs for an attorney/lawyer are also being paid but the court
coupon depends on the income of the applying person. Should an objection be
filed it will also be covered by this.
Those who enter court proceedings may
apply for financial support for the proceedings as to cover the
expenses.
Proceedings benefits
Prozesskostenhilfe The amount of
proceedings benefits granted depends upon the income and if there is a minimum
chance of success. For a rough estimation of the prospects of success it will be
necessary to have access to the proceedings’documents as soon as possible as the
payment of benefits will otherweise be rejected.
If the benefits were
sustained and you will loose the action, then the costs for your own lawyer and
for the proceedings are covered, costs that might come up for the lawyer of the
opposition side are not being paid.
